Yesterday after the SEC persecution of LBRY trial. Great to see so many come out in support–definitely felt like the olden days. The SEC was SEC-ing like the gang of federales they are, but I was impressed with the judge who seems to understand that he is unnecessarily destroying livelihoods and an important crypto market leader for no other reason than the SEC is unwilling to say WTF they want. Weak people and institutions, beholden to no one with unlimited taxpayer funds, play these kinds of very expensive and destructive games. Shameful, SEC, just plain shameful. Putting American entrepreneurs and family men out of business for spite. (I’m not pictured because I took the photo.)
Judge Barbadoro also said two very important things: THERE WAS NO FRAUD (i.e. no victim; no crime, this is simply the state aggressing against people they don’t like, in other words, this is a pure and simple case of POLITICAL PROSECUTION) and NATIVE TOKENS ARE NOT SECURITIES & secondary markets are exempt.

Some initial thoughts on the targeting by the Deep State of #bitcoin and #crypto activists in the Free State:
The SEC’s case against LBRY and the FBI’s case against Keene Bitcoin ATM operators have nothing to do with each other, other than the undeniable fact that Big Gov is now shamelessly targeting peaceful political dissidents who are participants of the Free State Project, where I serve on the board. Free Staters subscribe to the ethical stance of the “nonaggression principle,” applied equally to all human interactions (i.e. “the government” doesn’t get a free pass to bully you against your will). Free Staters are determined to lead the way to a better future by dismantling corrupt and immoral crony structures through entrepreneurial human action.
We have a big PR battle ahead of us, and it is going to be all hands on deck to make sure our friends and neighbors in the Free State understand the following:
In NH, just as numerous states have nullified cannabis laws over the past decade, crypto transactions are exempt from federal money transmitters laws. See: https://www.jdsupra.com/…/new-hampshire-exempts…/
In NH, based on my current understanding of past similar situations, either the local NH law enforcement was not authorized to act with federal agents, or the entire case must be done in NH courts. (See: https://www.aclu.org/…/federal-immigration-officials…)
Bitcoin and other crypto currencies were designed in part to hedge against inflation caused by flagrant monetary expansion. If you don’t understand this sentence, you cannot be a juror on these cases. Jury nullification, thanks to past work by free staters, is alive and well in NH.
LBRY’s Odysee is a censor-proof platform. This must terrify our actively censoring Big (Bad) Bros and provides an unseemly motivation for their actions.
Ian Freeman and I don’t always see eye-to-eye but he is a peaceful man, and it is an insult to say he is a “danger to the community.” I’m glad to hear the bail refusal will be appealed. Side note: When did “innocent until proven guilty” go away? How can it be lawful to add things like “no alcohol” or “no phones” to bail conditions? We have so much stuff to fix, grr!
In order for these cases to have any legs, you’d need to apply the same “logic” to other institutions. Has a US bank or Paypal or Facebook never been used for a “romance scam” before? How is it the responsibility of the ATM operator to manage that? Doesn’t every US dollar note have traces of cocaine of it? Can we lock the Fed Gov up for that?
Clearly, this targeted federal government overreach is directed against leaders in the crypto industry because #crypto offers the most significant option to peacefully replace the most corrupt structures in the world in favor of decentralized power… in the hands of the people, for realz!
And it starts with what happens with these cases in the Free State of NH. Stay tuned…
Watching the documentary Cryptopia: Bitcoin, Blockchains, and Future of the Internet yesterday, I saw so many familiar faces, people I have interacted with and/or invited to speak at Free State events over the years–Roger Ver, Tone Vays, Vitalik Buterin, Andreas Andreopoulos, and more–I was reminded of how long I’ve been flirt-skirting the crypto community. A quick online search brought up a past coverage in Bitcoin Magazine, so I thought I’d share a couple.

They then left the Cape in the Great Trek to get away from the British. I left South Africa for the promise of a brighter future in America. I left California for New York for more opportunity. I left NYC for New Hampshire to pursue Liberty in Our Lifetime. MY lifetime. Before signing up for the FSP, I researched other options–moving back to South Africa, going to Belize, Uruguay, Argentina, the informed know the drill–but ultimately I decided I wanted to make a stand. I wanted to held build a community of like-minded people to see if we can keep one little slice of America free. We are turning the tide, we picked the right state, and now all we need is more…”
But what is this Free State Project that has let Bitcoin consume it to such a great extent? The underlying objective is simple. In 2001, a number of libertarian activists, disappointed with their failures to get anyone elected inside the United States’ Republican and Democrat-dominated federal government, decided to try a different strategy: find a state that is (i) already very free in both personal and economic matters, and (ii) has a low population, allowing for smaller groups to achieve significant change, and convince 20,000 people to move to that state to actively influence local politics in a libertarian direction. New Hampshire proved to be the perfect candidate; its current population is only 1.3 million, allowing 20,000 movers to have significant control over state politics simply by playing the dominant and evenly matched Republicans and Democrats against each other, and as far as freedom is concerned one must only look as far as the state’s motto: “Live Free or Die”.
The libertarian appeal of New Hampshire can be seen from the moment one drives in; on one highway leading into the state, on the border there is a sign stating that wearing seatbelts is mandatory for those under 18 – that is, unlike every other state, only for those under 18.
